Terms of service

Terms of service (abbreviated as "ToS" or "TOS"), is a legally binding agreement that governs the use of Krytoi Network Games (here is “krytoi texas hold’em”) and you (the user). When we mention in this agreement the word “krytoi/we/us/our” it means “krytoi texas hold’em game”. "You/your" means you as a user of the game.

Please read this Agreement carefully before accessing or using krytoi. By accessing Krytoi, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access Krytoi.

Krytoi reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to Krytoi following the posting of any changes to this Agreement constitutes acceptance of those changes.

Krytoi may terminate your access at any time if you violate one of these Terms of service, with or without notice, effective immediately. If you wish to terminate this Agreement you may simply discontinue using Krytoi.

You represent that you are 18 years old or older. 

2 - Ownership of Intellectual Property

All materials that are part of the Service are owned, controlled, or licensed by Krytoi Social Co. and are protected by law from unauthorized use. This includes graphics, designs, text, pictures, sound, information, applications, software, and other files/materials related to krytoi.

This Agreement does not transfer from Krytoi to you or third party intellectual property, and all right, title and interest in and to such property will remain solely with Krytoi.

Your use of Krytoi grants you no right or license to copy, redistribute, reproduce, publish or otherwise exploit material from the Service.

The entire contents of the Service are copyrighted under the Australian copyright laws and/or similar laws of other jurisdictions. Krytoi logo, are trademarks of Krytoi and may not be used.

You do not acquire any ownership rights by using this Service, downloading material from or uploading material to the Service, or purchasing any virtual currency.

3 - User Content

The term "User Content" means and refers to any and all content, which Krytoi site provides you to transmit, like data, comments, writings, text, graphics, photographs, or personally identifiable information or other material (collectively "User Content"), any material you transmit to Krytoi will be treated as non-confidential and non-proprietary. Any User Content uploaded to the service is subject, whether in whole or in part, to unlimited commercial, non-commercial and/or promotional use by Krytoi.

You are entirely responsible for the content of, and any harm resulting from, your User Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software, posted links.

You agree that your User Content is wholly original to you and you don’t have the right to sell/transfer it to any third party in any country.

Krytoi has no obligation to accept, display, review, monitor, or maintain any User Content. We have the right to delete User Content from the Service without notice for any reason at any time. Krytoi may move, re-format, edit, alter, distort, remove or refuse to exploit User Content without notice to you and without liability.

You agree that Krytoi will not under any circumstances be liable for any User Content, including, but not limited to, errors in any User Content, or any loss or damage incurred by use of the User Content.

 4 – In-Game Currencies

The service may include virtual, in-game currency and you can increase your virtual bank balance only through play or by buying it directly from Krytoi for “real world” money. Your purchase of “virtual currency” is limited, personal, non-transferable and you may not purchase, sell, exchange, or transfer outside the Service rules, else it is a violation of our Terms and Service and this may result in termination of your account with the service and possible legal action.

Krytoi is a free-to-play poker game intended for entertainment purposes only. While you may elect to make in-app purchases to enhance your gaming experience, there is no chance of winning real money.

Krytoi has the absolute right to manage, regulate, control, modify and/or eliminate such Virtual Currency with/or without notice or warning, and we shall have no liability to you or anyone for the exercise of such rights.

5 – Usage Rules

Your use of the Game and the Service are governed by certain rules. These rules maintained and enforced exclusively by Krytoi, must be adhered to by all users. It is your responsibility to know, understand and abide by these rules. The following rules are not meant to be exhaustive, and Krytoi reserves the right to determine which conduct it considers to be outside the spirit of the Game and to take such disciplinary measures as it sees fit up to and including termination and deletion of the Account.

a) You agree that your use of the Service shall be lawful and your User Content will not:

i) Include vulgar language or which are otherwise offensive, defamatory, obscene, hateful, or racially, ethnically, or otherwise objectionable;

ii) include profanity or any obscene, indecent, pornographic, sexual, or otherwise objectionable content or language;

iii) Subject to the rights of any other person or an entity without written authorization from that person or entity;

iv) Contains, or is substantially similar to a trademark or service mark, whether registered or not;

v) Belong to any religious figure or deity;

vi) Be related to drugs, sex, alcohol, or criminal activity;

 b) Communicating in-game with others, whether by text, posts, or any other method, is an integral part of the Game and the Service and is referred to here as "Chat." When engaging in Chat, you may not:

i) Transmit or post any content or language which, in the sole and absolute discretion of Krytoi, is deemed to be offensive, including without limitation content or language that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, sexually explicit, or racially, ethnically, or otherwise objectionable, nor may you use a misspelling or an alternative spelling to circumvent the content and language restrictions listed above;

ii) Harass, threaten, stalk, embarrass or cause distress, unwanted attention, or discomfort to any user of the Game;

iii) Send repeated unsolicited or unwelcome messages to a single user or repeatedly posting similar messages in a Chat area, including without limitation continuous advertisements to sell goods or services

Krytoi will not under any circumstances be liable for any activity within Communication Channels. You acknowledge that chats, postings or materials posted by users on the Communication Channels are neither endorsed nor controlled by Krytoi, and these communications should not be considered reviewed or approved by Krytoi.

Krytoi have the right to review materials posted to the Communication Channels and to remove any materials, at any time, with or without notice for any reason, at its sole discretion. Krytoi may also terminate or suspend your access to any Communication Channels at any time, without notice, for any reason.

c) You and your activities on the Service will not:

i) Disseminate or transmit viruses, worms, Trojan horses, RATs, keyboard loggers, time bombs, spyware, adware, cancelbots or any other malicious or invasive code or program;

ii) Reveal any personal information about another individual, including another person's address, phone number, e-mail address, credit card number or any information that may be used to track, contact or impersonate that individual;

iii) Attempt to impersonate any other party;

iv) Create user accounts by automated means or under false pretenses or mislead others as to the origins of your communications;

v) Make improper use of Krytoi support services or submit false reports of abuse or misconduct;

vi) Engage in any commercial activities, including, without limitation, any attempt to raise money for anyone or advertise or promote a product, service, website, pyramid scheme, or other multi-tiered marketing schemes;

vii) Transfer the virtual currency of the game to real money, so you cannot sell your content of virtual money/or account to others which belong only to you;

d) Rules of play:

The gameplay is what Krytoi all about, and we strictly enforce the rules that govern gameplay. Those acts include, but are not necessarily limited to, the following:

i) The use of multiple (or more) accounts to try to accumulate “Virtual Currency”. This behavior may hurt the spirit of the game and can be easily detectible and will result in all your accounts being suspended and/or banned.

ii) Losing hands-on purpose at the table to send chips to a friend (or yourself on another account) is a violation of our Terms of Service and is aggressively enforced through account suspensions and/or banning.

6 – How Long We Keep Your Information

We will retain personal information about you and connected with your account and/or the Services you use from us for as long as you have an active account with us. If you did not log-in our site for 18 months, we will delete your personal information and your account will be considered inactive with us.

7 – Disclaimers; Limitations; Waivers of Liability

You agree that use of the service is at your sole risk. Neither Krytoi nor its officers, directors, employees, agents, subsidiaries, licensors, or affiliates shall be liable in any way for damage or loss of any kind resulting from (a) the use of or inability to use the game or service including without limitation loss of goodwill, work stoppage, computer failure or malfunction; (b) the loss or damage to characters, accounts, statistics, inventories, or user profile information; (c) interruption of services including without limitation ISP disruptions, software or hardware failures or any other event which may result in a loss of data or disruption of service. In no event will Krytoi be liable to you or anyone else for any indirect, incidental, special, exemplary, or consequential damages.

8 – Changes to the Terms of Use Agreement or the Game

Krytoi reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement, or delete any of the terms and conditions of this Agreement at any time, including without limitation access policies, the availability of any feature of the Game or the Service, hours of availability, content, data, software, or equipment needed to access the Game or the Service, effective with or without prior notice; provided, however, that material changes (as determined in krytoi’s sole and absolute discretion) will be disclosed as follows: Krytoi will provide you with notification of any such changes like website posting, pop-up screen, or in-game notice. If any future changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you must terminate, and immediately stop using, the Game and the Account. Your continued use of the Game following any revision to this Agreement constitutes your complete and irrevocable acceptance of any and all such changes. Krytoi may change, modify, suspend, or discontinue any aspect of the Game at any time. Krytoi may also impose limits on certain features or restrict your access to the Game without notice or liability.

I HEREBY ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE FOREGOING TERMS OF USE AGREEMENT AND AGREE THAT MY USE OF THE GAME AND THE SERVICE IS AN ACKNOWLEDGMENT OF MY AGREEMENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS TERMS OF USE AGREEMENT.
